Usually, the Ministry of Home Affairs enforces the AFSPA where necessary.<strong>&nbsp;<\/strong><\/span><strong>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/strong><\/p>\n\n\n\n<p><strong>Why in news?<\/strong><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0);color:#6a0214\" class=\"has-inline-color\">Recently 14 civilians were killed in Nagaland in suspect of being terrorist (NSCN) by 21 para commando unit. Therefore, the Chief Minister Neiphiu Rio has demanded the repeal of\u00a0<strong>the Armed Forces (Special Powers) <\/strong>Act. He also \u00a0criticized the Union Government for extending the \u201cdisturbed area\u201d tag for Nagaland every year.<\/mark><\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img decoding=\"async\" src=\"https:\/\/www.visionq.co.in\/blog\/wp-content\/uploads\/2021\/12\/thediplomat_2015-07-02_07-09-36.jpg\" alt=\"\" class=\"wp-image-374\" width=\"827\" height=\"583\" srcset=\"https:\/\/www.visionq.co.in\/blog\/wp-content\/uploads\/2021\/12\/thediplomat_2015-07-02_07-09-36.jpg 600w, https:\/\/www.visionq.co.in\/blog\/wp-content\/uploads\/2021\/12\/thediplomat_2015-07-02_07-09-36-300x212.jpg 300w\" sizes=\"(max-width: 827px) 100vw, 827px\" \/><\/figure>\n\n\n\n<p><strong>What is AFSPA?<\/strong><\/p>\n\n\n\n<p>&nbsp;<span style=\"color:#a30003\" class=\"has-inline-color\">It was enacted by the Parliament and approved by the President in 1958.It confers certain&nbsp;<strong>special powers on members of the Armed Forces<\/strong>(military forces, air forces operating on the ground as land forces and any other armed forces of the Union (CRPF, BSF, ITBP etc)for carrying out&nbsp;<strong>proactive operations against the insurgents in a highly hostile environment.&nbsp;<\/strong>They have the authority to prohibit a&nbsp;<strong>gathering of five or more persons<\/strong>&nbsp;in an area.<\/span><\/p>\n\n\n\n<p><strong>&nbsp;&nbsp;&nbsp; History:<\/strong> The Act was promulgated by the British in response to the Quit India movement in 1942. After Independence, Prime Minister Jawaharlal Nehru decided to retain the Act, which was first brought in as an ordnance and then notified as an Act in 1958.<\/p>\n\n\n\n<p>AFSPA has been imposed on the Northeast states, Jammu &amp; Kashmir, and Punjab during the militancy years. Punjab was the first state from where it was repealed, followed by Tripura and Meghalaya. It remains in force in Nagaland, Manipur, Assam, J&amp;K, and parts of Arunachal Pradesh.<\/p>\n\n\n\n<p><strong>Why we need this law?<\/strong><\/p>\n\n\n\n<p><strong>&nbsp;Armed Forces are deployed&nbsp;<\/strong>in<strong>counter-insurgency \/ terrorist operations<\/strong>&nbsp;when all other forces available to the State&nbsp;<strong>have failed to bring the situation under control.<\/strong> Armed forces operating in such an environment require certain special powers and protection in the form of an enabling law.
